By accessing or using Classtally ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Classtally is an attendance management platform designed for educational institutions. The Service allows teachers to create digital classrooms, track student attendance through photo check-ins, manage classroom behavior, and issue digital hall passes.

3. User Accounts

3.1 Teacher Accounts

• Teachers may create an account to access additional features including saved classes and student rosters
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration
• You must be at least 18 years old to create a teacher account

3.2 Student Use

• Students do not need accounts to check in to classes
• Students may be required to provide their name and take a photo for attendance purposes
• Students under 18 should have parental consent before using the Service

4. Acceptable Use

You agree to use Classtally only for lawful educational purposes. You will NOT:

• Use the Service to harass, abuse, or harm others
• Upload inappropriate, offensive, or illegal content
• Attempt to access other users' accounts or data
• Interfere with or disrupt the Service
• Use the Service for any commercial purpose without authorization
• Violate any applicable laws or regulations

5. Content and Photos

5.1 User-Generated Content

• Teachers are responsible for all content they create or upload
• Students who upload photos for attendance consent to their use within the classroom context
• You retain ownership of your content, but grant Classtally a license to use it to provide the Service

5.2 Photo Use

• Student photos are used solely for attendance verification within their specific class
• Photos may be viewed by the teacher and school administrators
• Photos are not shared with third parties for marketing purposes
• Photos may be deleted upon request (contact team@classtally.com)

6. Educational Use and FERPA Compliance

• Classtally is designed for use in educational settings
• Teachers and schools are responsible for complying with FERPA and other applicable privacy laws
• Attendance data should be treated as educational records
• Schools should have proper consent from students/parents before using the Service

7. Beta/Pilot Program

• Classtally is currently in a pilot testing phase
• The Service may contain bugs or incomplete features
• Features may be added, modified, or removed during the pilot period
• We appreciate feedback to improve the Service

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• CLASSTALLY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
